Welcome to Lumily. By downloading, installing, or using the Lumily mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

3. Pro Subscriptions

Lumily offers optional Pro subscriptions that unlock additional features:

Subscriptions are managed by Google Play and subject to Google Play's terms. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Google Play account settings.

You retain full ownership of any photos you process with Lumily. We do not claim any rights over your images. All processing happens on your device, and your photos are not uploaded to our servers.

The App, including its design, code, and AI models, is the intellectual property of Lumily AI. The AI processing technology is based on DCT-Net by Alibaba DAMO Academy, used under the Apache License 2.0. A copy of this license is available at apache.org/licenses/LICENSE-2.0.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMILY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the United States.

11. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts specified in the Governing Law section above.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
